Dustin Dow focuses his practice on nationwide class actions and employment and labor representation, with clients including financial institutions, multinational companies and employers of all sizes. With comprehensive litigation experience, Dustin manages clients' needs throughout the litigation process, from pre-discovery to appeals. Drawing on his background as a journalist, Dustin aggressively uncovers the facts of the matters facing his clients and provides clear answers and recommendations to help them effectively achieve their goals. As the editor of the firm's annual class action review, Dustin is continually abreast of the most recent and relevant trends affecting companies dealing with potential class action liability.

A former journalist with strong First Amendment interests, Dustin is a member of the City Club of Cleveland and serves on its Special Programming Committee and other initiatives.

  • Defended an Ohio-based regional bank against repeat class actions alleging an implied breach of the duty of good faith and fair dealing in connection with calculating interest rates as part of commercial loan billing practices. On motion, the case was ultimately dismissed from both federal and state courts.
  • Represents clients facing all manner of labor and employment law claims, from multiplaintiff discrimination trials to appeals of agency rulings. Recently won class decertification of a nationwide wage and hour collective action involving the exempt status of service industry employees. Post-conditional certification work revealed that the opt-in employees' deposition testimony reflected too much job duty disparity to justify certification.
