Partner Jeremy Anderson advised LG Electronics Inc. and secured a favorable appellate victory, resulting in a judgment by the Delaware Supreme Court of $12.8 million to LG versus $4.9 million previously set by the same court.

The dispute began when Intellectual Ventures (IV) sued two LG customers, both major automotive manufacturers, for patent infringement in Texas federal courts regarding their use of telematics control units supplied by LG, despite an existing patent license agreement between LG and IV. LG then sued IV for breach of contract in the Delaware Superior Court.

After trial, the jury found that the defendants, Intellectual Ventures (IV entities), breached the patent license agreement and entered a verdict awarding LG the full amount of damages LG sought. The trial court, however, reduced LG’s recovery. LG appealed to the Delaware Supreme Court, which concluded that: LG’s products were covered by the license agreement; IV owed LG $12.8 million in damages; and that LG’s litigation costs should be recovered as the prevailing party.

The case goes back to the Delaware Superior Court with instructions to enter a $12.8 million judgment in favor of LG, plus prejudgment interest and recoverable litigation costs.
