Partners James Sherer and May Tal Gongolevsky and Associate Jonathan Maddalone co-authored an article for the American Bar Association’s Litigation Section titled “Beyond the Bates Stamp: How Artificial Intelligence is Reshaping Discovery and Data Governance.” The article examines AI discovery risk, which is exacerbated by the fact that three overlapping groups can claim ownership:
- Legal – owns privilege, preservation and production decisions
- Information governance – owns retention and disposition
- Privacy – owns personal information obligations, including the distinction between anonymous data and everything else
