Partner Joyce Ackerbaum Cox commented on Florida’s new non-compete law in a <em>Corporate Counsel</em> article titled “Florida’s New, Pro-Employer Non-Compete Law Rife with Ambiguities That Will Vex Compliance Teams.” Published July 22, 2025, the article discusses how the new Contracts Honoring Opportunity, Investment, Confidentiality and Economic Growth (CHOICE) Act is going against a national trend of less use of non-competes, while also causing confusion when compared to Florida Statute 542.335 from 1996. CHOICE gives employers more latitude to hold certain workers to non-compete agreements for up to four years, while 542.335 states that non-competes longer than two years are presumptively invalid.
