Counsel Julian Perlman co-authored an article published Oct. 9, 2020, in Antitrust Connect, a publication of the Antitrust Section of the ABA. Perlman is a member of the Exemptions & Immunities Committee of the Antitrust Section. The article is a summary of the recent decision in Federal Trade Commission v. AbbVie Inc., in which the Third Circuit overturned one of the two district court rulings against AbbVie and Besins for alleged sham litigation, reinstated a reverse payment claim, and reversed a court-ordered disgorgement penalty of $448 million, holding that disgorgement is not an available remedy under Section 13(b) of the Federal Trade Commission.  <a href="https://connect.americanbar.org/antitrust/communities/community-home/digestviewer?tab=digestviewer&CommunityKey=09c0ac3b-a0e3-4c22-932f-c9d47ee8c83a">Read the article (registration required)</a>.
