Enacted in 1991, the Telephone Consumer Protection Act (TCPA) has governed telemarketing for nearly 35 years. As texting has come to dominate the telecommunications landscape, companies seeking to deploy compliant text messaging programs now have to contend with decades of FCC regulations and orders; mobile industry rules; texting vendor requirements; and a deluge of class action lawsuits. If this wasn’t complex enough, on June 20 the U.S. Supreme Court entered the chat with its ruling in <em>McLaughlin v. McKesson</em>, potentially calling into question many of the foundational compliance guardrails companies have relied on for years.
