CFTC Provides Clarifying Guidance on Material Violations Regarding Self-Reporting, Cooperation, and Remediation System

The chemical industry and users of their products are no strangers to intense regulatory scrutiny and litigation, but increasingly conservative risk assessments, regulatory creep by government agencies, and an aggressive plaintiffs’ bar is driving an avalanche of regulatory action and litigation against the industry and downstream users of their products. This includes some chemicals that are widely used and have been around for decades, but only in recent years have become the focus of regulatory action and litigation. This panel will focus on ethylene oxide (EtO) and the so-called “forever chemicals,” per- and polyfluoroalkyl substances (PFAS). Both EtO and PFAS have many uses and serve critical functions, in many cases, with no readily apparent or suitable substitutes. Members of our <a href="https://www.bakerlaw.com/Environmental">Environmental</a> and <a href="https://www.bakerlaw.com/ProductLiabilityToxicTort">Product Liability and Toxic Tort</a> teams provided an update on federal and state regulation of EtO and PFAS, addressed potential risk management strategies that companies can take now to mitigate risks associated with EtO and PFAS, and discussed potential strategies to reduce EtO and PFAS litigation exposure.
