Courtney represents employers across the U.S. in class and collective actions under the Fair Labor Standards Act (FLSA) and counterpart state wage and hour laws, including actions involving allegations of unpaid overtime, off-the-clock work, misclassification, joint employment, improper calculation of the regular rate of pay and improper time rounding. She also represents employers and executives in high-stakes litigation involving claims for breach of non-competition, non-solicitation, non-recruitment and non-disclosure agreements, tortious interference, breach of fiduciary duty and misappropriation of trade secrets.
In addition, Courtney has experience defending employers before federal and state courts and administrative agencies such as the Equal Employment Opportunity Commission (EEOC) in matters involving claims of discrimination, harassment and retaliation under federal and state laws, including under Title VII, the Age Discrimination in Employment Act (ADEA) and the Americans with Disabilities Act (ADA).
Courtney leverages her significant litigation experience to advise multistate employers on drafting restrictive covenants, protecting trade secrets and confidential information and onboarding employees who are joining from a competitor. She also advises employers on a range of workplace legal issues and HR matters, including employee handbooks and policies, disputes with executives, employment agreements and offer letters, employee terminations, workforce reductions, severance agreements, compliance with federal and state employment laws, internal investigations and employment issues in mergers and acquisitions.

<li>Represented real estate franchise company in action to enjoin investor in company’s franchisees from working for a competitor in violation of non-competition provisions in franchise agreements.</li>
<li>Represented nationwide retailer in action against former executive to recover severance consideration for executive’s breach of non-solicitation and confidentiality provisions in separation agreement.</li>
<li>Represented nationwide restaurant chain in action against former executives alleging claims for breach of non-solicitation provisions and misappropriation of trade secrets.</li>
<li>Represented start-up company in injunction action against former employee to enforce non-disparagement provision in separation agreement.</li>
<li>Secured favorable resolution for advisory firm in pre-litigation dispute alleging firm’s prospective employees misappropriated trade secrets from their former employer.</li>

Wage and Hour Litigation
<ul>
<li>Secured favorable resolution for manufacturer in FLSA collective action and Rule 23 class action seeking overtime pay for time spent donning and doffing PPE, walking and retrieving tools, equipment and paperwork.</li>
<li>Defended retailer in FLSA collective action alleging assistant store managers were misclassified as exempt. Before class notice was issued, obtained summary judgment on one named plaintiff’s claims and withdrawal of order granting conditional certification.</li>
<li>Defended oilfield services company in FLSA collective action alleging field service representatives were misclassified as exempt.</li>

Title VII, ADA, ADEA and FMLA Litigation
<ul>
<li>Defended various clients before the EEOC and state administrative agencies against charges involving claims for retaliation and discrimination based on race, national origin, sex, age, disability and criminal history.</li>
<li>Represented energy construction company in multiplaintiff action filed by six former executives alleging claims for gender discrimination and retaliation.</li>
<li>Represented individual defendant in action filed by former employee under the ADA, the ADEA and Title VII. Obtained dismissal on basis that client did not employ the plaintiff.</li>
<li>Represented energy construction company in action filed by former employee alleging claims under the FMLA for retaliation and under the ADA for disability discrimination and retaliation.</li>
