Josh Bennett is a seasoned trial and appellate attorney who focuses on complex, high stakes litigation. He regularly handles federal matters involving trademark infringement, unfair competition, false advertising, copyright and patent infringement, antitrust, theft of trade secrets, First Amendment and civil rights, and data security. Josh also regularly handles a variety of state law disputes, including breach of contract and warranty, breach of fiduciary duty, deceptive trade practices, defamation and anti SLAPP actions. In representing clients in these various areas, Josh has also represented clients in internal and government investigations.
In his trial work, Josh has tried nearly a dozen cases to verdict. For his plaintiff clients, he has secured multimillion-dollar verdicts and settlements. For his defense clients, he has obtained full-defense victories, including against plaintiffs seeking over a billion dollars in damages.
In his appellate work, Josh has served as lead appellate counsel in numerous matters before the U.S. Courts of Appeals for the Fifth and Federal Circuits and appellate courts across Texas, including the Supreme Court of Texas. His appellate experience extends to assisting plaintiffs and defendants in developing effective legal strategies in trial courts that have achieved real results, such as preliminary injunctions, dismissal of entire actions or securing and preserving substantial verdicts.
