<li>Successfully represented several Fortune 500 companies with foreign oppositions against squatters who fraudulently applied for the registration of these companies’ house marks, attempting to take advantage of first-to-file system. Asserted opposition grounds based on foreign registrations through international treaties despite not having local registrations or prior-filed applications. Obtained favorable decisions in opposition proceedings and later secured protection of clients’ marks locally.</li>
<li>Successfully represented international pizza chain restaurant with foreign opposition in Cuba against local business that fraudulently used and applied for the registration of their famous house mark. Asserted opposition grounds based on foreign registrations through international treaties despite not having local registrations or prior-filed applications. Obtained favorable decision in opposition proceeding and secured protection of clients’ marks locally. Most importantly, the opposition decision recognized the mark’s fame in Cuba despite not being in use, because of evidence of product placement in various movies and tv shows featuring the mark that were aired on Cuban television.</li>
<li>Successfully prosecuted and obtained registration of prominent Florida boating company’s house mark before the United States trademark office. Developed persuasive arguments demonstrating that disclaimer of descriptive term did not apply because it required an improper dissection of the mark.</li>
<li>Successfully prosecuted and secured registration of trademark for tech giant Fortune 100 company before the Puerto Rico trademark office. In response to Office Action seeking disclaimer on descriptiveness grounds, argued that the term in question was suggestive rather than descriptive and provided evidence of prior registrations in which comparable terms had been accepted without disclaimer.</li>
<li>Successfully managed the protection of a global trademark portfolio for a major international automotive brand across multiple jurisdictions, including negotiating and drafting a worldwide coexistence agreement between parties with potentially conflicting marks. Resolved concerns related to the similarity of goods by crafting an agreement acceptable across several countries, enabling both parties to obtain trademark registrations without conflict.</li>
