Writing for the June 2022 edition of ABA Health eSource, Partner Ann O’Brien and Associate Lindsey Collins examine two cases the Justice Department lost in jury trials in Texas and Colorado federal courts.
In “DOJ Antitrust Division Loses Two Bellwether Criminal Antitrust No-Poach and Wage-Fixing Trials,” O’Brien and Collins describe the April verdicts as “a stinging rebuke” of the Antitrust Division. One jury rejected criminal antitrust charges against DaVita, a dialysis company, that involved an agreement with other companies not to hire each other’s workers. The other jury acquitted a former owner and director of a physical therapy staffing company of wage fixing.
