In a March 8, 2022, commentary for The Legal Intelligencer, Partner Carl Hittinger and Associate Jeanne-Michele Mariani explained that, while retiring Justice Stephen Breyer “left an indelible mark on antitrust case law,” his proposed successor’s views on antitrust are somewhat opaque. They explained that most antitrust-related opinions issued by Supreme Court nominee Ketanji Brown Jackson (currently serving on the U.S. Court of Appeals) have dealt with procedural or jurisdictional issues, not substantive ones.
