Partner Camille Bent was selected by the New York City Bar Association as one of three delegates to the 67th session of the United Nations Commission on International Trade Law (UNCITRAL) Working Group V (Insolvency Law), held Dec. 8–10, 2025, in Vienna, Austria. Bent also attended the UNCITRAL Colloquium on updates to the Guide to Enactment and Interpretation of the UNCITRAL Model Law on Cross Border Insolvency, also in Vienna, Dec. 11-12, 2025. UNCITRAL - the UN’s core legal body for modernizing and harmonizing international commercial law for more than 50 years - served as the forum for this work.
At the 67th session, Working Group V advanced a Model Law on Applicable Law in Insolvency Proceedings (MLAP) and a companion Draft Guide to Enactment, intended to bring predictability to cross-border cases by clarifying which law governs the commencement, conduct, closure and effects of insolvency proceedings. The group deliberated the nuances of the default lex fori concursus rule and several special exceptions, all designed to enhance and streamline the existing 1997 Model Law on Cross-Border Insolvency, which to date has been adopted by approximately 50 countries around the world.
