Partners Joe Holahan and Sally Yuanyuan Qin co-authored an article for The Legal Intelligencer titled “Enhanced Indemnities Under Contracts for Carriage of Goods at Sea.” The article discusses how ocean carriers in the U.S. can offer enhanced indemnity agreements beyond the Carriage of Goods by Sea Act’s $500 liability limit without insurance licensing if the indemnity is incidental to the transportation service, with courts applying a “principal object and purpose test” to distinguish such agreements from regulated insurance contracts.
