Partners Ryan Hedges and Brian McEvoy, together with Associate Phillip Kim, authored an article for Pratt’s Government Contracting Law Report titled “In Case of First Impression, Looking to AKS Precedent, Ninth Circuit Affirms EKRA Conviction for Improper Payments to Marketers.” Published in the October 2025 issue, the article discusses United States v. Schena, where the U.S. Court of Appeals for the Ninth Circuit, in a rare prosecution based on the Eliminating Kickbacks in Recovery Act, affirmed an EKRA jury conviction of a laboratory operator based on his improper payments to marketers.
