Matt's experience also includes defending employers in front of administrative agencies such as the Equal Employment Opportunity Commission (EEOC), the California Civil Rights Department, the National Labor Relations Board (NLRB), the California Occupational Safety and Health Appeals Board, and the Mine Safety and Health Review Commission. His notable litigation experience, paired with his thorough understanding of administrative law and regulatory compliance, enables Matt to provide clients with a comprehensive view of the issues they face.

Matt is frequently involved in labor relations matters. He has represented clients in contract negotiations as well as in union strikes and in related litigation before the NLRB. He is also a contributor to the Bargaining Table, the BakerHostetler Labor Relations team blog.

A frequent commentator on labor and employment issues, Matt has made contributions to academic literature, including a publication on the Private Attorneys General Act (PAGA). Matt’s publications have been cited in briefs and petitions filed with the U.S. Supreme Court, the California Supreme Court and the California Courts of Appeal, as well as in law review articles and other secondary sources.

<li>Prevailed on a summary judgment motion in federal court in an Employment Retirement Income Security Act withdrawal liability action, leading to walkaway settlement.</li>
<li>Prevailed on a motion to dismiss in federal court on a case of first impression regarding whether an applicant can assert retaliation claims under the California Labor Code, with the court finding that such claims cannot be brought by an applicant.</li>
<li>Prevailed on a motion to compel arbitration in federal court based on the novel theory that the plaintiff’s claims arose solely out of a collective bargaining agreement entered into between the plaintiff’s employer and union.</li>
<li>Defends entities and individual defendants against claims arising under the Fair Employment and Housing Act, Labor Code and the PAGA, as well as numerous other state and federal laws in single-plaintiff and class actions.</li>
<li>Prepares motions for summary judgment and judication and demurrers in single-plaintiff discrimination and retaliation matters.</li>
<li>Prepared a case for trial, including drafting motions in limine, special verdict forms, jury instructions and all other trial briefs.</li>
<li>Handles Occupational Safety and Health Act adjudicatory matters by drafting all documents responsive to Cal-OSHA and federal OSHA inquiries and prepares matters for hearing before administrative law judges.</li>
