A Dec. 19, 2022, Bloomberg Law article titled “Legal Clash Over Kids’ Data Sets State Power Battle” focuses on a court challenge to a new California law intended to protect youth on digital platforms.
The legal challenge by an industry group representing Meta and Google, among others, argues that the California Age-Appropriate Design Code Act, passed in August 2022, “would conflict with existing federal law, impose overly vague rules and force businesses to over-moderate content online to avoid fines, in violation of the First Amendment’s free speech protections,” according to the article.
Partner Jennifer Mitchell told Bloomberg Law that the law will cause businesses to “default children and teens into more restrictive settings” and challenge businesses to try to determine appropriate content for children of varying age groups. “That’s the ambiguity businesses will really struggle with,” she said.
