Overview

Sammantha Tillotson has experience litigating a wide-range of complex issues, including products liability, intentional torts, contractual disputes, construction disputes and state and federal appeals. She also has robust experience in insurance, data breach and privacy class action litigation. Sammantha is involved in all aspects of complex litigation in trial and appellate courts, with a concentration on managing and navigating multifaceted discovery matters, as well as drafting dispositive motions requiring the briefing of challenging and novel legal issues.

Sammantha is a zealous and dedicated client-centered advocate for those she represents, focusing on obtaining results that will best serve her clients’ business and litigation needs. In 2019, her outstanding legal advocacy was recognized in The Legal 500 Annual Guide, which named her as a top 500 attorney nationally in the category of Real Estate and Construction law for her work in products liability and construction litigation.

Prior to joining BakerHostetler, Sammantha worked at an insurance brokerage, placing and analyzing property and casualty insurance coverage for her clients in the technology, product manufacturing and life sciences fields. While working in this role, Sammantha obtained her property and casualty producer license and participated in other robust training that enabled her to effectively analyze and mitigate her client’s business risks -- a skill that she now utilizes in assessing business and litigation risk in her legal practice.

  • Obtained complete dismissal of claims against large insurance company without leave to amend in putative nation-wide class action alleging that insurer unlawfully failed to pay the sales taxes, title and registration fees on a replacement vehicles in breach of the automobile insurance policy.
  • Obtained summary judgment on behalf of two large insurance companies in Colorado state and federal courts on plaintiffs’ alleged breach of contract and declaratory judgment claims in putative class actions arising from alleged underpayment of underinsured/uninsured motorist benefits. Further represented these insurance companies on appeal, obtaining favorable orders upholding both the state and federal trial court decisions in the Colorado Court of Appeals and Tenth Circuit.
  • Represented exercise equipment manufacturer and assisted with trial preparation in products liability case that resulted in complete defense verdict for manufacturer on plaintiffs’ strict products liability, negligence, and breach of warranty claims in state court. Further represented her client in ensuing litigation concerning attorneys’ fees, which resulted in a large attorneys’ fees award by trial court in favor of manufacturer.

  • Obtained full summary judgment ruling in favor of hotel and resort company on Colorado Premises Liability Act claim brought by plaintiff alleging contraction of carbon monoxide poisoning from claimed defective fireplace in condominium.
  • Obtained voluntary dismissal with prejudice in action filed against auto refinancing company by consumer alleging violations of the Telephone Consumer Protection Act.
  • Obtained favorable class action settlement in large, complex putative class action asserting contract, quasi-contract, equitable, and negligence claims as well as alleged violations of consumer protection statutes against health care network following cyber-attack on its computer network.
  • Repeatedly obtained favorable settlement and dispositive motion rulings in actions brought against large auto manufacturer in Colorado state court alleging breach of warranty as well as violations of Colorado lemon law, the Magnuson Moss Warranty Act, and the Colorado Consumer Protection Act.
  • Obtained early favorable settlement and voluntary dismissal of putative nation-wide class action brought against meal delivery company following cyber-attack on theories of negligence, breach of contract, and violations of all states’ consumer protection statutes.
  • Regularly provide legal insurance claim benefit analyses for insurers with a focus on disputes involving automobile and property coverage as well as bad faith litigation in Colorado and other jurisdictions
  • Engaged in motions practice and assisted with trial preparation in products liability case that resulted in favorable jury verdict for manufacturer of large industrial machinery.
