Overview

Scott Simpkins advises clients on technology and intellectual property matters in business transactions. He drafts and negotiates corporate and intellectual property agreements, including data sharing, software licensing, publishing and technology development. He also provides patent procurement services and strategic counseling to a wide array of companies, from small entities to premier Fortune 100 corporations, enhancing their U.S. and international patent portfolios of mechanical, electrical and software patents. 

Before pursuing a career in law, Scott worked directly with other engineers to generate solutions to complex problems. His diverse experience includes serving as a software engineer on digital communications programs and working for a range of companies in the polymer industry. Scott's design, development and manufacturing knowledge enable him to better understand industry-specific needs, and to counsel small companies and prominent corporations on a variety of intellectual property matters.

  • Conducts due diligence to facilitate the transfer of intellectual property rights, including as part of mergers and acquisitions.
  • As a federal clerk, aided in the resolution of patent-related issues involving consolidation, preliminary injunctions, reasonable royalty determination, stay, stay pending inter partes review, summary judgment and more. Participated in Markman hearings and drafted claim construction orders for proceedings that involved an array of technologies, including pharmaceuticals, chemical compounds and complex computer systems.
