Before entering private practice, Jonathan served as a federal prosecutor in the U.S. Attorney’s Office for the Southern District of New York and as a Trial Attorney for the U.S. Department of Justice Civil Division. He leverages his decades of experience as a prosecutor, defense attorney and litigator to strategically present his client’s position in a light that most resonates with regulators, judges and jurors. Represented the client in parallel U.S. and U.K. investigations, securing a rare non-prosecution agreement with the DOJ and agreements with the SEC and the CFTC, including one of the first non-prosecution agreements executed by the CFTC for an individual.</li>

<li>Represented foreign oil exploration company in action brought by DOJ for civil forfeiture of $380 million award from an arbitration against Venezuelan state-owned oil company.</li>
<li>Represented Singapore office of multinational consulting firm in connection with criminal and civil asset forfeiture and money laundering investigation by DOJ.</li>

 Internal Investigations and Corporate Compliance Advice
<ul>
<li>Advised the U.S. subsidiary of an international industrial conglomerate on anti-money laundering and Bank Secrecy Act compliance.</li>
<li>Advised multinational consulting company on establishment of anti-money laundering and anti-corruption compliance policies and procedures for new U.S. subsidiary.</li>
<li>Conducted internal investigations for a hospital, a medical group and a public health contractor with regard to data incidents concerning HIPAA protected information and potential False Claims Act exposure</li>
<li>Conducted internal investigations for publicly and non-publicly traded corporations concerning issues related to the FCPA, the Bank Secrecy Act, potential insider trading, immigration laws, employment laws, ransomware attacks, and data breaches.</li>

Complex Civil Litigation
<ul>
<li>Represented through trial four former executives of an Internet services company in a civil action brought by the Federal Trade Commission in the Southern District of Florida alleging that the individuals, and more than 40 corporate entities, violated Section 5 of the FTC Act by operating websites that were allegedly deceptive and misleading to consumers.</li>
<li>Successfully defended in federal district court and on appeal a UK based, SEC registered, investment advisor in litigation with a US broker dealer concerning subscriptions into newly formed investment fund.</li>
<li>Represented private equity firm in federal district court litigation alleging fraud and breach of representations and warranties by former owners of portfolio company.</li>
<li>Represented New York public authority in federal jury trial involving breach of contract claims against a pharmacy benefit manager.</li>
<li>Represented and advised the court-appointed SEC receiver of the Michael Kenwood Group, LLC, a complex family of hedge funds operating as a Ponzi scheme through numerous investment companies and affiliates in the U.S., the Cayman Islands, and Latin America. Performed strategic decision making and counseled receiver on potential courses of action resulting in recovery of more than $300 million for defrauded investors. Supervised the team’s global investigation and federal district court litigation seeking assets misappropriated through purported offshore hedge funds operated by the fund principals.</li>
<li>Supervised various litigation teams of BakerHostetler attorneys and forensic professionals handling the investigation and litigation stemming from the firm’s appointment as counsel to the Securities Investor Protection Act (SIPA) Trustee in the liquidation of Bernard L. Madoff Investment Securities LLC in connection with Madoff’s Ponzi scheme.</li>
</ul>
 Prior Experience
<ul>
<li>As assistant U.S. attorney, Jonathan acted as the lead prosecutor in one of the largest mortgage fraud prosecutions in the Southern District of New York, resulting in the closure of a corrupt mortgage brokerage and title company and the convictions of dozens of real estate professionals, bank employees and attorneys. He was a senior member of a special strike force investigating mortgage fraud and other financial schemes in response to the financial crisis. He also investigated and prosecuted complex criminal cases involving bank, mortgage and other commercial fraud; securities fraud; insurance and healthcare fraud; offshore illegal Internet gambling; money laundering; international trafficking in counterfeit goods; racketeering; conspiracy; murder; robbery; obstruction of justice; extortion; alien smuggling; and narcotics offenses. Jonathan was a first chair trial lawyer on numerous federal criminal jury trials.</li>
<li>Gained significant civil litigation experience as a trial attorney in the Federal Programs Branch of the Civil Division of the U.S. Department of Justice. Defended federal statutes, policies, regulations and programs of national significance against challenges, including those based upon claimed violations of constitutional law. Successfully defended the U.S. in landmark NAFTA litigation, was lead counsel for the Overseas Private Investment Corporation in claims against the Islamic Republic of Iran and defended numerous federal agencies in a wide range of lawsuits. Received a special commendation award for Outstanding Service in the Civil Division.</li>
