In addition to his litigation and counseling work, Ryan is a recognized advocate for public-sector employers. He frequently represents clients in all facets of traditional labor law, including collective bargaining, grievance arbitration and labor relations strategy. <li>Prevailed on countless dispositive motions for large national clients ending cases brought by current and former employees in federal and state courts and administrative agencies, successfully defending against claims of harassment, retaliation, discrimination and wrongful termination under Title VII, ADA, ADEA, FMLA and many other federal and state laws.</li>
<li>Assisted major rail carriers, air carriers, and other clients across many industries at every phase of litigation in the successful defense of well over 100 employee whistleblower matters filed under the Federal Railroad Safety Act (FRSA), Wendell H. Ford Aviation Investment and Reform Act for the 21st Century (AIR21), Surface Transportation Assistance Act (STAA) and other federal and state law whistleblower protection statutes.</li>
<li>Obtained successful outcomes in countless arbitration matters, defending against challenges to employee discipline and alleged labor contract violations.</li>
<li>Defended a large automobile manufacturer in a disability discrimination matter. A former employee had attempted to return to work after a lengthy medical leave of absence but was denied reinstatement due to loss of seniority. Investigated the complaint, interviewed witnesses involved with the refusal to reinstate the employee and drafted a motion for summary judgment. The court awarded summary judgment in a favorable written opinion.</li>
<li>Defended a public transit authority from an unfair labor practice charge alleging unilateral implementation of policy by an employer. Investigated factual circumstances of the union’s allegations and drafted an administrative position statement, resulting in a dismissal of charge.</li>
<li>Represented Class I rail carrier in settlement discussions with the Federal Railroad Administration (FRA) to successfully resolve hundreds of alleged violations of federal regulations relating to railroad safety.</li>
<li>Assisted in the successful defense of a company in an Employee Retirement Income Security Act of 1974 denial of benefits action. The employee’s benefits payments were terminated when the client discovered he was employed elsewhere while on medical leave. Investigated and confirmed factual circumstances of the situation, analyzed applicable law and drafted a brief in support of the client’s decision to terminate benefits. Written decision was favorable to the client.</li>
<li>Defended a large automobile manufacturer in its refusal to pay a recruiter’s fee due to the absence of a signed contract. Interviewed key witnesses, assessed risk of liability to the company and negotiated a settlement of the case, which was favorable to the client.</li>
