Sean’s meticulous attention to detail and business-focused strategies ensure optimal outcomes in high-stakes matters, whether through early resolution or at trial. His strategic foresight and deep legal knowledge make him a pivotal member of his team, where he navigates complex legal challenges arising from cutting-edge technology.

Sean has served as lead counsel for defendants in class action litigation arising out of data breaches of all sizes, including some of the largest health care data breaches on record. He also defends clients in class actions alleging violations of state privacy laws including the California Consumer Privacy Act, the California Invasion of Privacy Act and the Colorado Prevention of Telemarketing Fraud Act.

In addition to his litigation work, Sean maintains a strong white collar defense practice where he leads internal investigations and defends corporations and individuals in government enforcement actions involving the U.S. Department of Justice and the U.S. Securities and Exchange Commission. Sean has investigated and defended numerous high-profile matters, both criminal and civil, involving alleged accounting and securities fraud, health care fraud, environmental violations arising out of the Clean Air and Clean Water Acts, violations of the False Claims Act and violations of the Foreign Corrupt Practices Act.

<li>Won a full dismissal on behalf of Trustwave Holdings, Inc. in a subrogation action brought by Ace American Insurance Co. alleging that companies providing data management and cybersecurity services did not properly prevent or mitigate a ransomware attack against policyholder CoWorx Staffing Services. Prevailed on grounds that the plaintiff failed to state any claim against Trustwave upon which relief could be granted. Ace Am. Ins. Co. v. Congruity 360, LLC, et al., Case No. 25-15657 (SDW) (JSA), 2026 WL 1810423 (D.N.J. June 24, 2026).</li>
<li>Obtained a complete, voluntary dismissal of three putative class actions filed against MACT Health Board, Inc., a health care consortium of federally recognized and non-federally recognized Indian tribes, on sovereign immunity grounds, following a ransomware attack that impacted MACT in November 2025.</li>
<li>Successfully achieved a full, voluntary dismissal on behalf of Unacast, Inc., Gravy Analytics, Inc., and Venntel, Inc. in a data breach class action, captioned Little, et al. v. Gravy Analytics, Inc., et al., Case No. 1:25-cv-00176-AJT-WBP (E.D. Va.), following a cybersecurity event where threat actors stole historical smartphone location data and posted a 1.4 GB sample on the dark web, which purportedly included over 30 million location data points.</li>
<li>Successfully achieved complete dismissal of a case against Magellan Health, Inc. under Rule 12(b)(6) in a putative class action filed in Arizona federal court which alleged claims arising out of a ransomware attack. Griffey v. Magellan Health Inc., 562 F. Supp. 3d 34 (D. Ariz. 2021).</li>
<li>Obtained, with prejudice, dismissal of a nationwide putative class action lawsuit filed in Nevada federal court against Envision Healthcare Corporation, which alleged claims stemming from a phishing attack on Envision’s systems. The decision, which ultimately was affirmed by the U.S. Court of Appeals for the Ninth Circuit, clarified the pleading standard for damages in the data breach-context under Rule 12(b)(6). Additionally, prevailed on a motion to stay discovery pending the court’s ruling on the motion to dismiss. Pruchnicki v. Envision Healthcare Corp., 439 F.Supp.3d 1226 (D. Nev. 2020), aff’d, 845 F. App’x 613 (9th Cir. 2021).</li>
<li>Successfully obtained summary judgment on behalf of Experian, which resulted in the complete dismissal of all claims, with prejudice, brought by a consumer under the Fair Credit Reporting Act (FCRA). The dismissal was later upheld by the U.S. Court of Appeals for the Fifth Circuit. Barron v. Equifax Information Services, LLC, No. 3:16-CV-690-DPJ-FKB, 2019 WL 13169892 (S.D. Miss. 2019), aff’d 802 F. App’x 161 (5th Cir. 2020). The decision was significant because it held that a credit reporting agency performs a reasonable reinvestigation of a consumer’s file within the meaning of the FCRA when it verifies the consumer’s file through the credit reporting agency’s Automated Consumer Dispute Verification (ACDV) system.</li>
<li>Successfully defeated a plaintiff’s emergency motion for a preliminary injunction filed in Colorado federal court after first-chairing an evidentiary hearing, conducting direct and cross examination of multiple witnesses, and delivering closing argument.</li>
<li>Secured a significant settlement for a Colorado-based Church Extension Fund in a defamation action filed in Maryland federal court.</li>
<li>Obtained, on behalf of an investment management firm, a complete dismissal of breach of contract claims brought by a disgruntled former executive in Denver District Court.</li>

White-Collar Defense &amp; Investigations
<ul>
<li>Obtained from DOJ a declination of criminal prosecution for a Fortune 10 pharmacy in a wide-ranging investigation of its opioid dispensing and distribution practices. In connection with the investigation, led dozens of witness interviews, led a team of more than 50 attorneys to respond to multiple government subpoenas, and helped present the factual findings of the company’s internal investigation to senior DOJ officials at Main Justice.</li>
<li>Represented the operator of an oil pipeline in connection with a criminal investigation into alleged violations of the federal Clean Air Act.</li>
<li>Obtained a favorable resolution of a criminal obstruction of justice investigation into a former judge.</li>
<li>Represented an NFL franchise in an internal investigation regarding the leaking of confidential information to the media.</li>
<li>Led numerous internal investigations for clients in a variety of industries, including construction, manufacturing and hospitality, specializing in investigating whistleblower and other allegations of fraud and potential regulatory violations with minimal client disruption.</li>
