Jamie also structures comprehensive compliance strategies to ensure that clients meet the requirements of their state privacy laws as well as any international regulations and/or restrictions that might be involved. In addition, she is continuing to monitor the legal issues emerging in the areas of biometrics and machine learning, with a particular focus on generative AI.

Jamie’s governmental background as an intern with the Computer Crimes and Intellectual Property Section of the Department of Justice and her clerkship at the U.S. District Court, District of Connecticut provided her with keen insight on how to best approach certain issues in the court system. In private practice before her clerkship, she views matters from both the business and judicial sides.

<li>Advised advertising technology clients on copyright infringement risks related to use of generative AI, including fair use defense elements, such as purpose and character of use, nature of the copyrighted work, amount and substantiality of the portion used and the effect on the market value.</li>
<li>Developed a comprehensive international AI copyright law heatmap, categorizing legal issues and emerging trends.</li>
<li>Conducted extensive research and analyzed extent of Japanese copyright exception for text and data mining, and the effects on companies both domestically and internationally.</li>

Privacy Governance

<li>Assists clients, including social media platforms and video game studios, in developing privacy-focused policies and terms of use, addressing issues related to user-generated content, data sharing and online consumer protection.</li>
<li>Provides guidance on comprehensive compliance strategies to meet the requirements of state privacy laws, including the California Consumer Privacy Act (CCPA) and other similar legislation enacted throughout the U.S.</li>
<li>Counsels on legally compliant disclosures regarding data management practices, incorporating opt-in and opt-out mechanisms for the collection, use and sharing of personal information.</li>
<li>Advises data importers and exporters on adhering to international data transfer restrictions and data localization requirements, such as data processing agreements under the European Union&#8217;s Standard Contractual Clauses.</li>
<li>Assisted with the drafting of data privacy compliance programs for Native American governments using established privacy laws, such as the General Data Protection Regulation (GDPR), comprehensive state privacy laws and federal laws in the U.S.</li>
<li>Advised on the application and drafting of contract terms related to the Family Educational Rights and Privacy Act (FERPA).</li>
<li>Helped lead large regional healthcare providers through implementation of CCPA compliance, including assessment of existing cookie practices, identification of enforcement risks and recommendations of remedial actions to ensure alignment with regulatory guidance and existing privacy law.</li>
<li>Reviews vendor contracts to align with clients&#8217; business objectives while addressing legal and regulatory requirements, including data protection laws and industry-specific regulations.</li>
<li>Tracks developments in state laws regarding the collection, storage and use of biometric data.</li>
<li>Assisted with response to inquiry initiated by state Attorney General about existing privacy practices.</li>

Tech and Commercial Transactions

<li>Collaborated with IncuBaker to deliver legal analysis for an international media company pertaining to master agreements, licensing agreements and sublicensing agreements.</li>
